Charitable Raffle Official Rules

1. DESCRIPTION: The 2022 ALS raffle is a charitable raffle whereby tickets are sold online here and in person at the ALS Association Mid-America Chapter ("Sponsor") located at 6405 Metcalf Avenue, Ste. 205, Overland Park, KS 66202.  The raffle begins at 9:00 a.m. Central Time ("CT") on January 24, 2021 and ends at 11:59 pm. on March 7th, 2022 (the "Raffle Period").

2. ELIGIBILITY: Participation is only open to legal residents of the states of Missouri and Kansas who are twenty one (21) years of age or older as of the date of entry. Employees of Sponsor and the immediate families and household members of Sponsor, are not eligible to win. Subject to all applicable Federal, state and local laws. Void where prohibited.

3. HOW TO ENTER: You may enter this raffle by purchasing a raffle ticket online at ANightofHopeKC.com or at the ALS office at the above address. By participating in the ALS Raffle, you agree to follow these Official Rules. By accepting a prize, you give Sponsor your permission (except where prohibited) to use your name, likeness and statements for publicity purposes without additional compensation including display of your name and image in social media postings and other fundraising materials related to the raffle.  All entries must be received during the applicable Raffle Period. The Pick Your Paradise Raffle is a donation of $100 per raffle ticket. Only 150 raffle tickets will be sold for the Pick Your Paradise.  The Holladay Experience Raffle is a donation of $50 per raffle ticket. Only 199 raffle tickets will be sold for the Holladay Experience Raffle.

4. DRAWINGS: Three prize winners will be selected in a random drawing from among all eligible entries received during the Raffle Period. The drawing will be held within five days from the end of the Raffle Period and will be conducted by Sponsor's staff.

5.  PRIZES:  One prize will be awarded.  The prize will be your choice of ONE of the following three trips:

Passport required for travel outside the U.S. Resort blackout dates: December 23-31. A minimum 30 day advance reservation is required. Travel is valid for 18 months from date of issue.

CANCELLATION POLICY: Any cancellation less than 21 days prior to arrival will be subject to forfeiture of reservations and funds.

Option 2: Buon Appetito in Tuscany- Cortona, Italy

6. ODDS: The odds of winning a prize are 1 in 125 for the Pick Your Paradise Raffle. The odds of winning a prize are 1 in 249 for the Happy Holladays with Chef Kansas City Raffle.  

7. GENERAL RULES: All entries and prize claims become the property of Sponsor and will not be returned. Released Parties (as defined below) assume no responsibility for lost, late, stolen, delayed, damaged, misdirected, undelivered, illegible, incomplete or postage-due entries, prize claims or mail. Released Parties are not responsible for typographical, printing or otherwise relating to or in connection with the ALS Raffle, including, without limitation, errors or difficulties which may occur in connection with the administration of the ALS Raffle, the processing of entries, the announcement of the prizes or in any ALS Raffle-related materials. Except where prohibited, by accepting a prize, winners consent to the use by Sponsor and its designees of their names and/or photographs for advertising and publicity purposes in any and all media now or hereafter known throughout the world in perpetuity without limitation and without additional compensation, notification or permission. By participating in this ALS Raffle, each entrant accepts and agrees (i) to be bound by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all respects, and (ii) to release Sponsor and its directors, officers, and employees (collectively, the "Released Parties") from any and all liability of any injuries, losses or damages of any kind caused by participating in this ALS Raffle or resulting from acceptance, or use/misuse of the prize. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the ALS Raffle, violates the Official Rules, or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THE ALS RAFFLE OR UNDERMINE THE LEGITIMATE OPERATION OF THE ALS RAFFLE IS A VIOLATION THE OFFICIAL RULES AND OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY INDIVIDUAL RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

8. DISPUTES: Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this ALS Raffle, or any prizes awarded, shall be resolved individually, without resorting to any form of class action, and any judicial proceedings shall take place in a federal or state court within the state of Kansas.; 2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this ALS Raffle, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the ALS Raffle, shall be governed by, and construed in accordance with the laws of the State of Kansas, without giving effect to any choice of law or conflict of law, rules or provisions (whether of the State of Kansas, or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Kansas. IN NO EVENT SHALL SPONSOR OR THE OTHER RELEASED PARTIES BE LIABLE TO ANY ENTRANT OR WINNER FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZE TO BE AWARDED TO ANY INDIVIDUAL ENTRANT IN THIS ALS RAFFLE.

9. WINNERS LIST: For a list of winners send a self-addressed stamped envelope to: "ALS Association Mid-America Chapter ("Sponsor") located at 6405 Metcalf Avenue, Ste. 205, Overland Park, KS 66202." Requests must be received within ninety (90) days after the final Raffle Period.
